Terms and Conditions

1. General Provisions
1.1 The Provider: PT KINETIKA SURFING METHODS (NIB 1272000613504; NPWP 42.872.348.0-905.000).
1.2 The Client: An individual over 18 years old who wishes to use the services offered by Kinetika Surfing Methods and has accepted the terms of this offer by registering or making a payment.
1.3 The Offer applies to all services listed on the website https://kinetika.surf (hereinafter referred to as "the Website").
1.4 The acceptance of this Offer constitutes a binding agreement between the Client and the Provider.

2. Services
2.1 The Provider offers surfing lessons, trips, and camps as described on the Website.
2.2 The content, schedule, and pricing for services are detailed on the Website and may be updated by the Provider. Updates are effective immediately upon publication.
2.3 The Provider reserves the right to use third-party services for delivering the agreed services.
2.4 Services are conducted in accordance with the Provider’s schedule and program and are subject to weather and safety conditions.

3. Payments
3.1 Payment methods include bank transfer, payment via the Momence app, or other methods agreed upon between the parties.
3.2 Full payment is required unless otherwise agreed. For trips and camps, a 50% deposit is mandatory.
3.3 Prices are listed in the local currency of the Provider's location. Clients are responsible for covering any additional transaction fees or currency conversion charges.

4. Client Obligations
4.1 The Client agrees to provide accurate personal details and inform the Provider of any health conditions that might affect participation.
4.2 The Client agrees to follow all safety instructions and refrain from disruptive behavior.
4.3 The Client is responsible for securing personal insurance coverage. The Provider does not offer medical coverage for injuries.

5. Cancellation and Rescheduling
5.1 Lessons may be canceled or rescheduled by the Client no later than 6:00 PM (GMT+8) the day before the lesson.
5.2 The Provider reserves the right to cancel or reschedule lessons due to adverse weather conditions or safety concerns. In such cases, the Provider will offer a reschedule or refund as appropriate.
5.3 If the Client cancels a lesson after the cut-off time, the lesson will be considered completed, and no refund or reschedule will be provided.
5.4 For trips and camps, cancellations must be made no later than 7 days before the start date to qualify for a partial refund, minus the non-refundable deposit and any incurred expenses.
5.5 Missed lessons without prior notification will not be refunded or rescheduled. Exceptions may be considered for emergencies at the sole discretion of the Provider.

6. Liability
6.1 The Provider is not liable for injuries or accidents resulting from non-compliance with safety instructions or personal negligence.
6.2 The Provider ensures the quality of the equipment provided but is not responsible for damage caused by improper use by the Client.
6.3 The Client agrees to indemnify the Provider against claims arising from breaches of these terms.

7. Use of Media
7.1 The Provider may record photos and videos during lessons and events. By accepting this Offer, the Client consents to such recording and its use for promotional purposes.
7.2 The Client may request to opt-out of media usage by notifying the Provider in advance.

Refund Policy
1. General Rules
1.1 Refunds are only issued under the following conditions:
  • Cancellation by the Provider due to unforeseen circumstances or safety concerns.
  • The Client cancels services in compliance with the terms outlined in the cancellation policy.
1.2 Refunds for services are processed after deducting transaction fees, costs of materials already provided, and other incurred expenses.

2. Deposit and Payments
2.1 Deposits for trips and camps are non-refundable. These deposits cover planning and administrative costs.
2.2 Full refunds for lessons or services canceled by the Client will only be issued if cancellation is made before the cut-off time specified in the Terms and Conditions.
2.3 For packages or bulk purchases, refunds are calculated based on the number of unused lessons, minus any administrative fees.

3. Service Interruptions
3.1 If lessons are interrupted due to weather or safety issues:
  • If less than 60 minutes of the lesson has been completed, the lesson will be rescheduled or a partial refund issued.
  • If more than 60 minutes of the lesson has been completed, the lesson will be considered completed, and no refund will be provided.
3.2 Services disrupted by force majeure are not subject to refund unless otherwise agreed.

4. Refund Process
4.1 Refund requests must be submitted in writing to mail@kinetika.surf or via the designated communication channels.
4.2 Refund requests should include the Client's name, contact information, and a detailed explanation of the reason for the refund.
4.3 Refunds will be issued within 14 working days of the approved request, less any applicable fees and incurred expenses.
4.4 For payments made via third-party platforms, the refund will be processed through the same platform, and additional fees may apply.

5. Non-Refundable Cases
5.1 Missed lessons without proper cancellation notice or valid reasons.
5.2 Voluntary non-participation in pre-scheduled trips, camps, or lessons.
5.3 Services completed in accordance with the agreement.
5.4 Refunds are not available for discounted or promotional packages once payment has been processed.

6. Special Considerations
6.1 At the Provider's discretion, exceptions to the refund policy may be made for emergencies or other unforeseen circumstances. Supporting documentation may be required.
